The
occasional need to reduce staffing may require implementation of a
reduction of force in a board of education's teaching or nonteaching
staff. Compliance with contractual and legal procedures is required,
with the risk of a back pay award if the board of education is found
to have acted incorrectly. Pepple & Waggoner has guided boards
of education through many reductions in force, from drafting board
policies regarding such reductions, to defending a board's reduction
in staff in arbitration or other legal proceedings.
